They advised that vehicle #1 was parked facing Northbound in the Shopko parking lot. The pedestrian approached vehicle #1 and was speaking to the driver of vehicle #1 through the driver side window. As they were speaking, vehicle #1 moved forward. As vehicle #1 moved forward the driver side rear tire of vehicle #1 ran over the pedestrians' left foot.

He was advised that the vehicle was a dump truck and had been in an accident in Payson and there were several calls regarding the driving pattern of the truck. Prior to Officer Rudds arrival he was advised that the vehicle had been in a second accident and was stopped on the side of the road. Officer Rudd contacted the driver of the dump truck and could smell the odor of an alcoholic beverage on his breath. The driver was asked to perform field sobriety tests. Based on the performance of these tests it was felt that the driver could not safely operate a vehicle. He was arrested and transported to the jail.
